xAI, the artificial intelligence startup launched by Elon Musk in July 2023, is once again in the headlines—not for a technological breakthrough, but for its aggressive fundraising push. The National Association for the Advancement of Colored People (NAACP), through the Southern Environmental Law Center (SELC), has issued a 60-day legal notice—a prerequisite under U.S. environmental law before filing a formal lawsuit—accusing xAI of violating the federal Clean Air Act.

According to the SELC, xAI has illegally installed dozens of methane gas turbines at its South Memphis facility without acquiring the proper air quality permits or installing federally required emission control systems. The organization alleges that these unregulated turbines have worsened an already dire pollution situation in the area.

The data center in question is located near predominantly Black neighborhoods, many of which have a long history of exposure to industrial pollution. One such community, Boxtown, reportedly has a cancer risk four times higher than the national average.

Community groups and residents have repeatedly expressed concerns about the health implications of xAI’s operations since the facility became operational in 2024. Hundreds of residents have submitted formal complaints to the Shelby County Health Department, calling attention to what they see as unchecked corporate activity.

Making matters worse, xAI is currently constructing a second data center in the Whitehaven area of Memphis, but has yet to disclose what energy sources will power the new site. Local leaders fear the same pattern of pollution and regulatory disregard could be repeated.

As public anger grows and environmental watchdogs turn up the pressure, xAI’s expansion plans may face substantial delays, regulatory scrutiny, or even court-ordered halts.
